I. Basic provisions

These General Terms and Conditions (hereinafter referred to as the GTC) govern the relations between the parties to the lease agreement, where on the one hand is: Pohoda Services sro, ID: 45966371, VAT: 2023172701, VAT ID: SK2023172701, Operations: TIC Čingov CUBE ADVENTURE, Čingov 1149 , 052 01 Spišské Tomášovce, Chata na Rázcestí, Čingov 1152, 052 01 Spišské Tomášovce., As the seller (hereinafter referred to as the "landlord") and on the other hand is the tenant (hereinafter referred to as the "tenant"). By placing an order, the Lessee confirms that he has read these GTC

II. Lease agreement

The lease agreement is created by sending the order to the tenant and receiving the order by the landlord. The landlord will immediately confirm this acceptance to the tenant by informative email to the specified email, however, this confirmation does not affect the formation of the contract. The resulting contract (including the agreed price) can be changed or canceled only by agreement of the parties or on legal grounds. For an exception to this procedure, see point VI. Ordering.

The concluded contract is archived by the lessor for a period in accordance with the relevant legal regulations, for the purpose of its successful fulfillment and is not accessible to third non-participating parties.

By concluding a lease agreement, the lessor undertakes to lease the selected sports equipment to the lessee, which is the subject of the lease, and the buyer undertakes to take over the selected sports equipment and pay the lessor the rental price. The landlord hands over to the tenant sports equipment, checked by a mechanic or. operator, in a ready-to-use condition.

III. Information security and protection

The Landlord declares that all personal data is confidential and will be used only to perform the contract with the Lessee. None of the provided personal data will be otherwise disclosed, provided to a third party and the like, with the exception listed below and situations related to distribution or payment related to the ordered service (notification of name, account number).

The Lessee has the right to access and correct their personal data, including the right to request an explanation and removal of the erroneous condition and other legal rights to this data. The lessor may further process the so-called "Cookies" to facilitate the provision of information society services in accordance with the provisions of Directive 95/46 / EC on the purpose of "cookies" or similar tools and to ensure that users are aware of the information stored in the terminal equipment they use, kaktusbike. for this purpose, it sets separate conditions for the use of cookies. Users have the option of refusing to allow "cookies" or similar tools to be stored on their end devices, for example by launching incognito browsing functionality in their browser.

Due to the prevention of criminal activity and minimization of damages, the landlord reserves the right to reject the tenant's order created from a blocked IP address if this IP address is on the so-called blacklist. In case of problems with the order, the tenant can contact the landlord via the contact form, which is located here or by phone.

IV. Operating hours

Sports equipment can be borrowed and handed over during opening hours, more precisely Mon - Sun: 07:00 - 18:00, in the shop TIC Čingov CUBE ADVENTURE, Čingov 1149, 052 01 Spišské Tomášovce or Chata na Rázcestí, Čingov 1152, 052 01 Spišské Tomášovce. In the event of a failure of the information system or force majeure, the seller is not responsible for non-compliance with operating hours.

V. The price

There are always current and valid prices in the ordering system. Prices are final.

The lessee rents the goods at the price valid at the time of ordering. The lessee has the opportunity to get acquainted with the total price and all other fees before placing the order. This price will be stated in the order and in the message confirming the receipt of the order of goods. Before placing the order, the lessee has the opportunity to get acquainted with the fact for how long the offer or price remains valid. The Lessee acknowledges that there may be cases where no contract is concluded between the Lessor and the Lessee, especially if the Lessee orders the goods at a price published in error due to an error in the Lessor's internal information system. In such a case, the Lessor informs the Buyer of such a fact.

The Lessor reserves the right to declare the lease as invalid if personal data has been misused, the payment card has been misused, etc., or due to the intervention of an administrative or judicial authority, the Lessee will be informed of such a procedure. The Lessee acknowledges that in the above cases, the lease agreement cannot be validly concluded.

VI. Ordering

It is possible to order on the website www.cubeadventure.sk, or in person at the seller's premises.

VII. Terms of payment

The landlord accepts the following payment terms:

Payment in cash up to 5,000 euros when taking over the object of lease at the point of issue, payment via the payment terminal when taking over the goods at the point of issue (payment card), or through the payment gateway at www.cubeadventure.sk

Buyer billing information cannot be changed retroactively after sending the order.

VIII. Terms of Delivery

The landlord only provides personal collection at the point of issue. Without the submission of any documents such as OP (ID card, passport), the landlord may refuse to release the goods.

IX. Final provisions

Any disputes between the landlord and the tenant can also be resolved out of court. In such a case, the buyer-consumer can contact the subject of out-of-court dispute resolution, such as the Slovak Trade Inspection. These General Terms and Conditions are valid and effective from 01.06.2020. The Lessor reserves the right to change the GTC without prior notice.

Cancellation fees

In case of cancellation of the binding reservation by the lessee, the lessor will charge the lessee a fee for cancellation of the binding reservation (cancellation fee) in the amount of:

30 days or more before download: free of charge
from 29 to 15 days before the day of collection: 50% of the total rental amount
from 14 to 7 days before the day of collection: 65% of the total rental amount
from 6 to 3 days before the day of collection: 80% of the total rental amount
2 days until the day of the start of the lease 100% of the total amount for the lease
